We were instructed by a client as a result of an accident that occurred whilst she was on holiday in Turkey. She agreed to go on an excursion which was booked independently.
The excursion consisted mainly of holidaymakers, many of whom were British. Whilst on the excursion, the party stopped at a jetty for a break and a swim. The boat moored at the end of the jetty and whilst our client was in the process of walking down the jetty she was pushed from behind, without warning, by a young boy into the water. He thought it was part of a game. The water was very shallow and as a result, she sustained a fracture to her leg on landing.
A claim was pursued against the child for causing the accident and also against the person who was responsible for him at the time. Settlement was agreed with the child’s holiday insurers after proceedings were issued but several weeks prior to the trial. The client received £4,500 in damages. |
