We were instructed by Master J who suffered from burns and psychiatric shock as a result of an accident on holiday. At the time of the accident J was only 5 years old.
J was playing in the terrace garden of the SAS Radisson Hotel in Taba, Egypt when he came into contact with a faulty electrical socket. The socket exploded, throwing our client across the room. He sustained burns to his chest which left him with permanent scarring. He also went on to develop post traumatic anxiety.
We were instructed to pursue a holiday compensation claim for him against his tour operator, TUI. He was able to bring a claim for this holiday accident because of the Package Travel Regulations. We used our expertise to show that the standards in the hotel were insufficient and that there was more than one area of the hotel where faulty sockets were a problem.
It was necessary to issue court proceeding against TUI, but it was possible to reach a settlement before the need to attend a trial.
The matter was dealt with by Sheetal Patel in our spcialist Travel & Toursim Department. She commented:
"J was very lucky not be have been more seriously injured. The state of many of the sockets in the hotel was totally unnaceptable. Even after sending the holiday company photographic evidence of the state of the soclets they still denied liablity. However, in the end, after we issued the claim at court, they made a sensible offer to settle the claim and I'm pleased that J was compensated."
