Ms P and her partner booked a package holiday with Thomson Ski (part of Tui Travel plc) for 7 nights. The package included flights, transfers, ski packages and accommodation at the Diana Parc Hotel. Facilities at the hotel included a spa.
Two days into the holiday, on 3 March 2009, Ms P visited the spa at the hotel, which had a Jacuzzi. On entering the Jacuzzi, Ms P cut her foot on a sharp tile under the water, sustaining a laceration to her right foot. Her partner immediately pulled her out of the pool and attempted first aid.
Ms P was eventually taken to hospital where surgical glue and dressings were applied to the wound. As a result of her injury Ms P was unable to snowboard for the remainder of the holiday and long term was left with two small superficial scars on her right foot.
We were instructed to bring a holiday compensation claim to try and recover damages for the injury and also the loss of enjoyment of the holiday.
The holiday claim was pursued against TUI because they were the provider of the package holiday. After TUI failed to make a reasonable offer of settlement, we issued court proceedings. Shortly afterwards agreemnt was reached to settle MsP's holiday compensation claim for £2,250.
