We were instructed by a family who contracted food poisoning whilst on holiday in Egypt. The family holiday was booked with TUI to the Brayka Bay Hotel in Marsa Alam in Egypt. The holiday was booked as a package to this all-inclusive resort and as a result, the holiday food poisoning claim was pursued against the tour operator, TUI.
Investigations in resort identified that there were many other guests who had been affected in a similar way and we were able to get relevant evidence to show that TUI, as the holiday organiser were responsible for the holiday compensation claim. Informal reports from the resort suggested that at least 18 people were affected, but it's probable that it was many more.
This family of 3 all suffered from stomach cramps and diarrhoea, resulting in a ruined holiday as well as the significant pain and suffering.The food preparation and food control in resort were poor. For example, the food was not properly cooked before being served, it was often left uncovered and food was often reheated.
The food poisoning caused significant long term bowel problems for one member of the family. On her return to the UK she was diagnosed as having been infected with Salmonella Gastroenteritis. Although the condition improved, it was anticipated that minor, but very inconvenient symptoms would persist for the rest of her life.
After extensive investigations and correspondence, we were able to conclude this holiday food poisoning claim without the need to issue legal proceedings. In total, the family were awarded more than £27,000. |
