We were instructed by a client as a result of an accident which occurred onboard a First Choice Airways flight to his holiday destination. Whilst serving hot drinks during a turbulent period of the flight, an air hostess accidentally knocked a cup of hot coffee into our client’s lap, causing significant burns and injuries. It then took 40 minutes before he received any further attention. We were asked to bring a holiday compensation claim for him.
The claim was pursued in line with the Montreal Convention which governs accidents which occur during international flights.
In this case it was for the airline to prove that they had not been negligent because of the way in which the relevant convention works. The burden of proof normally rests with the person bringing the holiday claim. They were not able to do so and liability was promptly admitted and damages agreed in the sum of £6,000. |
