We were instructed by Mr M to pursue a holiday compensation claim as a result of an accident he was involved in whilst skiing in France. The circumstances of the accident were hotly disputed and there was a disagreement as to who was at fault. We were instructed to pursue a holiday claim on his behalf and also defend the counter-claim being brought by the other skier involved.
The matter was pursued through the English Courts because both skiers were English. However, it was complicated by the fact that French law was applied because that was where the accidnet happened. In the end, because of a quirk of French law, both parties were compensated by the insurer of the other party.
Mr M’s holiday claim was settled in the sum of £8,000. He had sustained superficial facial injuries and minor neck pain during the accidnet. The other party’s claim was settled for in excess of £50,000 because he suffered from a nasty knee injury and was unable to work for a significant period after the accident.
